By accessing or using Scolly AI (the “Service”), operated by Scolly AI Labs (“we,” “us,” or “our”), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

Scolly AI is an AI-powered personal assistant that provides conversational AI, memory management, background tasks, reminders, web search, image analysis, and integrations with third-party services such as Google Calendar. The Service is available via scolly.ai.

3. User Accounts

You may create an account using an email address and password or by signing in with Google. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must be at least 13 years old to use the Service.

4. Guest Access

You may try the Service without creating an account through our guest mode, which allows a limited number of messages. Guest conversations may be deleted at any time without notice.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or to violate any laws
  • Attempt to gain unauthorized access to the Service or its related systems
  • Use the Service to generate content that is harmful, abusive, harassing, or threatening
  • Interfere with or disrupt the Service or its infrastructure
  • Use automated tools, bots, or scrapers to access the Service beyond its intended use
  • Reverse-engineer, decompile, or attempt to extract the source code of the Service
  • Circumvent rate limits, security measures, or access controls

6. AI-Generated Content

The Service uses AI models to generate responses. You acknowledge that:

  • AI-generated content may not always be accurate, complete, or up-to-date
  • You should independently verify important information before relying on it
  • AI responses do not constitute professional advice (medical, legal, financial, or otherwise)
  • We are not liable for decisions made based on AI-generated content

7. Your Content

You retain ownership of the content you submit to the Service (messages, images, memories). By using the Service, you grant us a limited license to process your content solely for the purpose of providing the Service to you. We do not claim ownership of your content.

8. Shared Conversations

You may share conversations via a public link. When you share a conversation, its contents become accessible to anyone with the link. You are responsible for ensuring that shared conversations do not contain sensitive personal information. You can revoke sharing at any time.

9. Third-Party Integrations

The Service may integrate with third-party services such as Google Calendar. Your use of these integrations is subject to the respective third party's terms of service and privacy policy. We are not responsible for the practices of third-party services.

10. Pricing & Free Tier

Scolly AI is currently offered free of charge. We reserve the right to introduce paid plans or modify the free tier at any time. We will provide reasonable notice before any pricing changes take effect.

11. Service Availability

We strive to keep the Service available at all times but do not guarantee uninterrupted access. The Service may be temporarily unavailable for maintenance, updates, or due to circumstances beyond our control.

12. Intellectual Property

The Service, including its design, branding, code, and AI capabilities, is the intellectual property of Scolly AI Labs. You may not copy, modify, or distribute any part of the Service without our prior written consent.

13. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

14. Limitation of Liability

To the maximum extent permitted by law, Scolly AI Labs shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Service.

15. Termination

We may suspend or terminate your access to the Service at any time for violation of these terms or for any other reason at our discretion. You may delete your account at any time through the Settings page. Upon termination, your data will be handled in accordance with our Privacy Policy.

16. Changes to These Terms

We may update these Terms of Service from time to time. We will notify you of material changes by posting the updated terms on this page and updating the “Last updated” date. Your continued use of the Service after changes constitutes acceptance of the updated terms.

17. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Washington, United States, without regard to its conflict of law provisions.
